Yes. A service at an independent garage does not void the manufacturer warranty, provided you follow the manufacturer's service schedule and keep proof of it. EU competition law has required that of carmakers since 2010. Three cases are exceptions, and that is precisely where the three-year bill on a luxury car is decided.
The rest of the question is paperwork.
Can I service my premium car outside the dealer network without losing the warranty?
Yes, and the basis is legal: paragraph 69 of the supplementary guidelines the European Commission published in the Official Journal of 28 May 2010. The text targets the case where the manufacturer's warranty, legal or extended, is made conditional on the buyer having all work not covered by the warranty done exclusively within the authorised network. The same applies to a warranty requiring brand parts for replacements not covered. A distribution network that does this falls outside the exemption framework, and the Commission considers it unlikely to justify itself.
That framework is still in force. Regulation 461/2010, to which the guidelines are attached, was extended by Regulation 2023/822 until 31 May 2028.
The Commission clarified a point service books often exploit: it does not matter where the restriction is written. Sales contract, warranty booklet, service book, the analysis is the same. A line such as "servicing required at an authorised repairer" in a booklet carries no more weight than on an order form.
The warranty covers manufacturing defects. It does not buy you as a workshop customer.
What conditions keep the manufacturer warranty intact?
Five, and none of them depends on the badge above the workshop door. The BMW, MINI and BMW i warranty terms for Belgium, version 2026/01, are a good example of a real text, because they spell out the grounds for exclusion instead of relying on a slogan.
- Follow the content and frequency of servicing prescribed by the manufacturer, owner's manual included, which BMW phrases as "with the required expertise and brand-specific tools".
- Fit original parts or parts of matching quality. BMW excludes the warranty if foreign-origin parts are fitted; under paragraph 69, that ground only holds for a fault caused by the part in question.
- Keep the service book up to date, paper or digital. BMW explicitly requires it as proof.
- Do not modify the software. Chiptuning voids the BMW warranty, even when done by a dealer.
- Do not leave a dongle plugged into the OBD port. It is the newest and least known clause: BMW sees it as a vulnerable digital access point to the car.
That last point deserves a second read if your insurer or fleet manager has fitted a telematics box. The independent garage has nothing to do with it, and yet it is the kind of exclusion discovered at claim time.
When is the dealer network still compulsory?
In three cases of principle, plus a few ancillary covers that Belgian importers tie to their network. The table below lists the situations a premium car owner actually meets.
| Situation | Outside the network? | Reference |
|---|---|---|
| Servicing and routine maintenance, manufacturer warranty running | Yes, in principle | EU guidelines 2010, paragraph 69 |
| Repair covered by the warranty, recall, free servicing | No | EU guidelines 2010, paragraph 39 |
| Warranty extension issued at sale or shortly after | Yes, in principle | Commission FAQ, question 2 |
| Extension bought or activated years after purchase | No, a network condition is accepted | Commission FAQ, question 4 |
| Leased car, transfer of ownership not certain | No, the lessor may require the network | Commission FAQ, question 7 |
| Leased car with purchase certain | Yes, in principle | Commission FAQ, question 7 |
| BMW 12-year corrosion warranty | Bodywork checks at a BMW partner | BMW Belgium terms 2026/01 |
| Mercedes-Benz 24-month tyre warranty | Tyres bought and fitted at an Authorised Service Point | Mercedes-Benz Belgium |
The last two rows are not part of the warranty against vehicle defects. They are ancillary covers, and an owner leaving the network simply needs to know they stay behind.
Leased company car: can the lessor impose the dealer?
Yes, as long as the car does not belong to you. At the top of the Belgian market, where company cars weigh heavily, this is the case where the European answer flips.
The Commission wrote it in its FAQ of 27 August 2012 on the motor vehicle sector: a leasing company linked to the manufacturer may require servicing in the authorised network with brand parts, as long as it is not certain that ownership will pass to the lessee. Its justification is residual value. A lessor taking the car back at 48 months resells it better with a full network history.
The logic reverses once transfer is certain, because the contract provides for it or the lessee has exercised the purchase option. The lessor then has no interest of its own to assert and is in the position of an ordinary seller.
For an employee on operational leasing, the question is settled in advance. For a self-employed driver on financial leasing with a purchase option, the contract deserves a second read on the date the option is exercised. Rents and return charges are detailed in what leasing a luxury car in Belgium really costs.
Lexus Relax, Mercedes WarrantyExtension: what does leaving the network cost?
On a Lexus, sometimes more than it saves. On a Mercedes-Benz or a BMW, much less.
Lexus Belgium is explicit. The factory warranty covers three years or 100,000 km, with no mileage limit for the first two years. After that, every annual service carried out in the official network extends the Relax warranty by one year or 15,000 km, until the car reaches ten years or 185,000 km. A service done elsewhere extends nothing. The extension is free, stays with the car on resale, and can be reactivated even after servicing outside the network.
Several garage websites present the equivalent Toyota programme, Toyota Relax, as compatible with independent servicing. For the extension, that is wrong: it is only triggered in the network.
At Mercedes-Benz Belgium, the manufacturer warranty is two years with no mileage limit, plus a third year included as standard up to 200,000 km. Beyond that, the WarrantyExtension programme sells from €522 including VAT a year, maximum recommended price valid until 31 August 2027, for an extension of one to four years. The public page makes it conditional on servicing in line with manufacturer guidelines, without spelling out the network. The full terms sit with the Authorised Service Point, and those are what to read before signing.
That €522 puts a market price on a year of extended warranty. It lets us quantify the Lexus trade-off: for leaving the network to pay off, the independent garage has to save at least that much every year. At the midpoint of the hourly rate ranges set out below, a gap of €36.30 including VAT per hour, it takes 14.4 billed labour hours a year to reach €522. If your annual service bills fewer, and your invoices will tell you, staying in the Lexus network costs less than the warranty you give up by leaving.
How much does leaving the dealer save?
Between €25 and €35 excluding VAT per hour comparing the low and high ends of the ranges, €36.30 including VAT at the midpoint. It is a real gap, but it concerns labour, not the whole invoice.
| Workshop type, 2024 ranges | Hourly rate excl. VAT | Hourly rate incl. 21% VAT |
|---|---|---|
| Premium brand dealer | €90 to €120 | €108.90 to €145.20 |
| Specialist premium independent | €65 to €85 | €78.65 to €102.85 |
| Franchise chain | €55 to €70 | €66.55 to €84.70 |
| General independent | €50 to €65 | €60.50 to €78.65 |
Recorded on 10 November 2024, source GarageMetrics: these are the only public, dated ranges I found for the Belgian market as of 26 September 2026, and no official series updates them. They are two years old and predate the salary indexations since, and I publish them as such rather than extrapolate.
At the midpoint of the ranges, €105 excluding VAT at the dealer against €75 at a specialist independent, the gap is €30 excluding VAT, or €36.30 including VAT per hour. Over ten workshop hours, €363. The calculation says nothing about parts prices, which can widen or narrow the gap depending on whether the independent fits original parts or parts of matching quality.
Region matters too. The same source reports a common 10 to 15 percent gap between Flanders, more expensive, and Wallonia, and higher rates in Brussels and Walloon Brabant than in Hainaut or Luxembourg province. The warranty rule itself is identical in all three regions: it comes from EU and federal law, not from a regional decree.
Does the two-year legal guarantee change anything?
Nothing, which is good news. The legal guarantee is owed by the professional seller to the consumer for two years from delivery. It does not depend on the manufacturer or on the workshop chosen for servicing.
The FPS Economy, the Belgian federal economy ministry, points out that for sales concluded from 1 June 2022 the burden of proof rests on the seller for the whole legal guarantee period on a new item, no longer only for the first six months. On a used item, the period can be contractually reduced to one year. Faced with a lack of conformity, you can therefore turn to the seller even if the manufacturer's commercial warranty is refused.
A warranty refusal has to prove a causal link
Paragraph 69 says so in its last sentence: a manufacturer may legitimately refuse a warranty claim if the fault is causally linked to a service carried out incorrectly or to a poor-quality part. Not merely because the service took place elsewhere.
One example is enough. An engine that snaps its timing chain after an overdue oil change with an off-spec oil opens a real discussion. A central display that fails on a car serviced by an independent opens none.
The proof is prepared before the fault, and it takes few documents:
- The itemised invoice for every service: date, mileage, work done, references and standards of oils and parts.
- The service book kept up to date, paper or digital. The Commission considers that an independent must be able to update the manufacturer's electronic history.
- The Car-Pass, the Belgian mileage certificate, which dates the odometer readings logged at workshop visits.
- In case of refusal, the manufacturer's written reasons, which you contest by registered letter if the causal link is not established.
The choice of workshop does not only matter during the warranty. The heavy items that come afterwards are costed in air suspension replacement cost, and a complete history weighs on luxury car depreciation at resale. For a first purchase, the most forgiving used premium cars compare Lexus, Volvo and Audi over three years. Cost of ownership model by model is in the luxury car ranking.
